Terms of Service
1. Acceptance of Terms
By accessing or using Centimailer ("the Service"), you enter into a legally binding agreement with Centimailer. If you are registering on behalf of an entity, company, or organization, you represent and warrant that you possess the authority to bind that entity to these Terms.
2. Account Security & Workspace Management
You are responsible for maintaining the confidentiality of your account credentials, API tokens, and session identifiers. Any activities conducted under your workspace credentials are your sole responsibility. You agree to notify Centimailer immediately upon discovering any unauthorized account access.
3. Permitted Use & Compliance with Laws
Centimailer provides email distribution, audience management, template authoring, and delivery routing. You agree to use the Service strictly in compliance with all applicable regional and international laws, including the CAN-SPAM Act (USA), the General Data Protection Regulation (GDPR / ePrivacy Directive, EU), the Canadian Anti-Spam Legislation (CASL), and applicable telecommunications regulations.
4. Sender Identity Ownership & DNS Alignment
You represent and warrant that you own or have explicit authorization to send from any email addresses and domain names configured within your workspace. You are responsible for configuring proper DNS authentication records (SPF, DKIM, DMARC) on your sending domains to maintain deliverability and prevent identity spoofing.
5. Deliverability & Provider Acceptance Disclaimers
Centimailer transmits campaign messages to recipient mail servers via optimized routing channels. A status of "sent" or "accepted" confirms that our delivery infrastructure successfully transferred the message to the recipient's mail transfer agent (MTA).
Deliverability Notice: Centimailer cannot guarantee inbox placement. Final placement (inbox, promotions, or spam folder) is determined solely by recipient email providers (e.g., Google Workspace, Microsoft 365, Yahoo) based on domain reputation, sender authentication, message content, and recipient engagement history.
6. Subscription Plans, Quotas & Prepaid Balances
Platform usage is governed by your active tier (Free, Starter, Pro, or Agency). Quotas operate on a rolling 30-day window basis. Unused monthly sending capacity does not roll over to subsequent periods. Prepaid account balances deposited via cryptocurrency or card do not expire while your account remains active and in good standing.
7. Anti-Abuse & Immediate Suspension Rights
To protect our sending IP pools and domain reputation for all users, Centimailer strictly enforces its Acceptable Use Policy (AUP). We reserve the right to immediately throttle, suspend, or terminate any account that violates the AUP, generates excessive spam complaints, or disseminates fraudulent content, without prior notice and without refund.
8. Intellectual Property & User Content
You retain complete ownership and intellectual property rights in your email copy, templates, and recipient contact data. Centimailer claims no ownership over user content. Centimailer retains all rights, title, and interest in its software, brand assets, APIs, and infrastructure.
9. Limitation of Liability & Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, Centimailer and its operators shall not be liable for any indirect, incidental, punitive, or consequential damages, loss of profits, business disruption, or loss of data. Our aggregate liability for all claims arising from the Service shall not exceed the total amount paid by you to Centimailer in the three (3) months preceding the incident.
10. Modifications & Governing Law
We may revise these Terms periodically. Notice of significant changes will be published in your workspace dashboard or via email. Continued use of the platform constitutes acceptance of updated terms.
